Content And Brand Usage Policy

1. Scope And Purpose

BHPH Success content is protected by applicable intellectual property, contract, trademark, copyright, database, and other laws.

Public availability of BHPH Success content does not mean that the content may be freely copied, modified, redistributed, commercialized, or used without restriction.

This Policy is intended to permit reasonable promotional and informational uses while preventing misleading, inaccurate, competitive, or unauthorized exploitation of BHPH Success content.

2. What Is BHPH Success Content?

For purposes of this Policy, "BHPH Success Content" may include:

• Research and reports;
• Marketplace statistics;
• Dealer-interest information;
• Vendor-performance information;
• Marketplace analytics;
• Aggregated or derived data;
• Research methodologies;
• Scoring methodologies;
• Articles and editorial content;
• Images and videos;
• HTML widgets or embedded assets;
• Marketplace taxonomy; and
• Other content created, compiled, licensed, or distributed by BHPH Success.

3. General Usage Rules

Any permitted use of BHPH Success Content must be accurate, current, appropriately attributed, and presented with sufficient context to avoid misleading users.

You must:

• Use BHPH Success Content only for legitimate purposes;
• Accurately identify BHPH Success as the source where appropriate;
• Preserve the meaning and context of quoted material;
• Use official BHPH Success assets where provided;
• Comply with applicable trademark and copyright requirements;
• Comply with any restrictions accompanying a specific asset, report, badge, or service;
• Clearly distinguish BHPH Success Content from content supplied by another marketplace or source; and
• Stop using content when your right to use that content expires or is revoked.

A permitted reference to BHPH Success does not grant ownership of the underlying content or intellectual property.

4. Logos, Trademarks, And Brand Assets

• Combine the BHPH Success logo with another logo in a way that creates a new composite mark;
• Use BHPH Success branding as your own business branding;
• Suggest that BHPH Success operates, owns, sponsors, or controls your company;
• Use BHPH Success branding in a manner that falsely implies certification or endorsement;
• Register domains, social accounts, business names, products, or trademarks that are confusingly similar to BHPH Success;
• Remove copyright, trademark, or proprietary notices; or
• Use BHPH Success branding in unlawful, deceptive, defamatory, or misleading materials.

5. Reviews And Review Excerpts

A vendor may generally quote legitimate BHPH Success reviews concerning its own company, products, or services, subject to this Policy.

Review Quotes Must Be Accurate

Quoted review language must be reproduced accurately and must not be edited in a way that materially changes the meaning or sentiment of the reviewer.

You may not selectively remove relevant language if doing so creates a materially misleading impression.

Example

If a review states:

You should not publish only "The software works well" if removing the remaining language materially misrepresents the reviewer's overall statement.

Review Attribution

Where technically and reasonably possible, externally quoted reviews should identify BHPH Success as the source and link to the applicable BHPH Success review or vendor profile.

Review attribution must respect any anonymity or privacy setting associated with the original review.

Reviews Of Other Vendors

You may not copy or republish another vendor's BHPH Success reviews primarily for competitive attacks, negative advertising, harassment, or misleading comparisons.

Nothing in this section prohibits fair and lawful comparative statements based on independently verifiable information where those statements otherwise comply with this Policy.

6. Ratings, Scores, And Rankings

BHPH Success may publish ratings, scores, rankings, popularity indicators, category placement, review counts, marketplace metrics, or similar information.

If you reference these metrics externally, you must accurately represent the metric as published.

You may not:

• Recalculate a BHPH Success rating and present the result as an official BHPH Success rating;
• Modify a score or rating;
• Remove material qualifiers;
• Misrepresent a category ranking as an overall marketplace ranking;
• Represent historical positioning as current without appropriate context;
• Convert ordinary marketplace placement into an award or certification;
• Represent paid placement as an organic ranking;
• Misstate the number or source of reviews underlying a rating; or
• Use BHPH Success data to create a misleading performance claim.

Because rankings, ratings, reviews, and marketplace information may change over time, BHPH Success may require that outdated promotional references be updated or discontinued.

7. Badges, Awards, And Marketplace Recognition

BHPH Success may establish badges, awards, verification indicators, recognition programs, or other marketplace distinctions.

Examples may include:

• Verified Vendor;
• Dealer Recommended;
• Top Rated Vendor;
• Category recognition;
• Dealer Choice recognition;
• Most Reviewed recognition; or
• Other programs established by BHPH Success.

A business may use an official badge or recognition only if:

• The badge or recognition was actually issued or authorized by BHPH Success;
• The business satisfies any continuing eligibility requirements;
• The official asset is used without unauthorized alteration;
• The badge is not used beyond any stated expiration or eligibility period;
• The badge is not represented as broader recognition than was actually granted; and
• Any required attribution, link, or disclosure is included.

8. Graphics, Charts, Widgets, And Visual Assets

BHPH Success may provide graphics, comparison assets, review widgets, badges, charts, promotional images, or other visual materials.

Unless BHPH Success expressly allows customization, official visual assets must be displayed substantially as provided.

You may not:

• Alter data contained in an official graphic;
• Remove material labels or disclosures;
• Crop an asset in a manner that changes its meaning;
• Overlay misleading claims;
• Modify review text within a graphic;
• Change rankings, ratings, or scores;
• Recreate a BHPH Success graphic in a manner that falsely appears official;
• Disable required links within an official widget; or
• Use an outdated asset where BHPH Success requires a current version.

Reasonable resizing for placement may be permitted so long as the asset remains legible, proportional, and otherwise unaltered.

9. Comparisons And Competitive Claims

Vendors may make lawful comparative claims, but they may not use BHPH Success Content in a misleading or unfair manner.

You may not:

• Use BHPH Success reviews primarily to attack another vendor;
• Manipulate marketplace statistics to manufacture a competitive advantage;
• Present selective data while concealing material context;
• Misrepresent BHPH Success as having endorsed your competitive claim;
• Modify BHPH Success comparison results;
• Present your own methodology as though it were a BHPH Success methodology;
• Combine unrelated BHPH Success data points to create an unsupported claim; or
• Use BHPH Success intellectual property to create a competing marketplace, ranking product, or review service.

If BHPH Success provides an official comparison graphic or tool, applicable usage rules for that asset may also apply.

10. Marketplace Data And Derived Data

BHPH Success may generate marketplace information from dealer activity, vendor activity, reviews, searches, profile engagement, category activity, inquiries, advertising activity, and other marketplace interactions.

This may include:

• Marketplace statistics;
• Aggregated dealer activity;
• Vendor engagement metrics;
• Category demand;
• Profile traffic;
• Advertising performance;
• Review trends;
• Benchmark information;
• Rankings;
• Scores;
• Inferences;
• Recommendations;
• Dealer-interest signals; and
• Other aggregated, transformed, inferred, or derived information.

Access to marketplace data does not transfer ownership of the underlying BHPH Success database, marketplace dataset, methodology, or derived information.

Unless expressly authorized, you may not:

• Resell marketplace data;
• Sublicense marketplace data;
• Publish restricted marketplace data;
• Build a competing marketplace database using BHPH Success data;
• Reverse engineer BHPH Success scoring or ranking systems;
• Scrape or systematically extract marketplace information;
• Use marketplace data for unauthorized AI or machine-learning training; or
• Represent BHPH Success data as your independently collected data.

11. Marketplace Insights And Dealer-Interest Information

BHPH Success may make certain marketplace analytics or dealer-interest information available to eligible vendors.

Depending on the applicable service, authorized uses may include:

• Evaluating marketplace performance;
• Understanding category engagement;
• Improving marketing strategy;
• Understanding dealer interest in products or services;
• Prioritizing legitimate sales activity;
• Measuring advertising effectiveness;
• Evaluating marketplace positioning;
• Developing business strategy; and
• Other purposes authorized by BHPH Success.

Unless expressly authorized, marketplace insights may not be:

• Sold to another party;
• Published publicly;
• Shared with unrelated third parties;
• Used to identify individuals from aggregated or de-identified data;
• Altered and represented as official BHPH Success information;
• Used in violation of applicable privacy law;
• Used to harass dealers or other marketplace users; or
• Used outside the scope of the applicable vendor service.

12. Research, Reports, And Editorial Content

BHPH Success may publish research, reports, surveys, articles, benchmarks, category analyses, dealer insights, vendor analyses, or other editorial content.

Unless otherwise permitted:

• Excerpts must accurately reflect the original source;
• Material context may not be omitted if doing so creates a misleading impression;
• Charts or graphics may not be materially altered;
• BHPH Success should be identified as the source;
• A reference should link to the original source where reasonably possible;
• Draft or confidential research may not be externally disclosed;
• Content may not be used to falsely imply BHPH Success endorsement; and
• Additional licensing restrictions may apply to premium or licensed research.

BHPH Success may establish separate licensing terms for research, reprints, proprietary reports, or other premium content in the future.

13. Social Media, Advertising, Events, And Promotional Use

Permitted BHPH Success Content may be used in social media, websites, digital advertising, sales presentations, emails, events, trade-show materials, and other promotional channels when the use complies with this Policy.

Promotional use must not:

• Misrepresent BHPH Success as the advertiser;
• Imply an endorsement that does not exist;
• Alter review sentiment;
• Misstate rankings or ratings;
• Use unauthorized badges;
• Misrepresent sponsored placement as independent recognition;
• Hide required attribution;
• Use BHPH Success Content in unlawful advertising; or
• Otherwise create a materially misleading impression.

BHPH Success may require pre-approval for particular trademark uses, event signage, research references, licensed content, advertising campaigns, or other high-visibility uses.

14. Attribution And Required Disclosures

BHPH Success may require attribution, source links, trademark notices, review disclaimers, methodology references, dates, or other disclosures when its content is used externally.

Where appropriate, BHPH Success may require substantially the following disclosure when reviews are quoted or promoted:

Where appropriate, badges, ratings, rankings, or other recognition may require a disclosure explaining that the recognition is based on marketplace reviews, ratings, data, methodology, or other defined criteria and does not constitute a general endorsement of the vendor.

BHPH Success may publish additional attribution requirements for particular programs or assets.

15. Prohibited Uses

You may not use BHPH Success Content in a manner that:

• Is false, deceptive, or materially misleading;
• Misrepresents BHPH Success's views;
• Creates a false endorsement;
• Suggests a partnership that does not exist;
• Manipulates reviews, ratings, rankings, or statistics;
• Misquotes a reviewer;
• Removes material context from a review;
• Uses another vendor's reviews for an improper competitive attack;
• Uses an expired or unauthorized badge;
• Modifies official brand assets without permission;
• Resells restricted marketplace data;
• Publishes confidential marketplace insights;
• Infringes BHPH Success intellectual property;
• Competes with an existing BHPH Success content, data, research, or marketplace offering using BHPH Success material;
• Violates applicable privacy law;
• Violates advertising or consumer protection law;
• Promotes illegal activity;
• Damages or dilutes BHPH Success trademarks; or
• Otherwise violates BHPH Success agreements or policies.

16. Requests For Additional Permission

If you want to use BHPH Success Content in a manner not clearly permitted by this Policy, you should request written permission before using the content.

A request should identify:

• Your company or organization;
• The specific BHPH Success content you want to use;
• The original source or marketplace page;
• How the content will be used;
• Where the content will appear;
• The intended audience;
• How long the content will be used; and
• A draft, mock-up, or example where appropriate.

Permission is not granted unless BHPH Success provides written approval.

17. Enforcement And Policy Violations

BHPH Success may take reasonable action when this Policy is violated.

Depending on the circumstances, actions may include:

• Requesting correction of inaccurate content;
• Requiring removal of unauthorized content;
• Requiring updated attribution or disclosures;
• Revoking permission to use a badge or brand asset;
• Disabling widgets or digital assets;
• Restricting access to marketplace analytics or insights;
• Suspending promotional privileges;
• Restricting Vendor Services;
• Applying a marketplace integrity notice where appropriate;
• Suspending or terminating an account;
• Terminating applicable content licenses; or
• Pursuing remedies available under contract, trademark, copyright, privacy, unfair competition, or other applicable law.

Serious, repeated, intentional, or misleading misuse of BHPH Success Content may result in immediate action.

18. Changes To This Policy

BHPH Success may update this Content and Brand Usage Policy to reflect changes to marketplace content, badges, reviews, data products, research, intellectual property, promotional programs, business practices, or applicable law.

The "Last Updated" date displayed at the top of this page will identify the latest revision.

Continued use of BHPH Success Content after an updated Policy becomes effective constitutes acceptance of the updated Policy to the extent permitted by applicable law.
